Commission TOS

General Terms

1. Right of Refusal
   Caturteer reserves the right to reject any project at our discretion.

2. Behaviour and Communication
   Any individuals deemed rude, offensive, or disruptive may be blocked, and all communications will be cut off without prior warning.

3. Project Nature
   Projects of an unfavourable nature will not be accepted. This includes, but is not limited to, projects involving racism, politics, hate speech, extreme gore, or other controversial topics. If you are unsure whether your project falls into these categories, please contact us for clarification.

4. No Implied Relationship
   No client-service provider relationship is established until payment has been made. Caturteer will not be liable for any issues or obligations until this relationship is formally established.

5. Confidentiality
   All details discussed before the confirmation of a project are not considered confidential unless a Non-Disclosure Agreement (NDA) has been explicitly agreed upon.

6. Liability

   • Caturteer is not liable for any damages or losses resulting from the commencement of a project.

   • Caturteer is not liable for delays caused by the client's failure to respond promptly.

   • Caturteer is not liable for any delays or issues caused by acts of God or events outside of human control.

7. Finality of Terms
   All terms agreed upon before payment are final. Any additional conditions or deliverables may incur extra charges.

8. Legal Jurisdiction
   Any legal matters arising from these terms will be handled under the jurisdiction of Singapore.

Payment Terms

1. Payment Requirement
   Caturteer will only begin work on projects after the agreed payment has been received.

2. Currency and Quotations
   All prices quoted are in USD unless stated otherwise.

3. Payment Methods
   Accepted payment methods include PayPal, Wise, and Revolut.

4. Refund Policy

   • Once a project has commenced, no refunds will be entertained.

   • A partial refund may be granted at the discretion of Caturteer if a project is cancelled before commencement.

Live2D Rigging Revisions

1. Initial Design Phase

   • Sketch: 2 rounds of revisions allowed.

   • Line Art: 1 round of revisions allowed.

   • Colour: 1 round of revisions allowed.

2. Rigging Phase

   • Facial Base Rigging: 2 rounds of revisions allowed.

   • Facial Expressions: 2 rounds of revisions allowed.

   • Head X, Y Rigging: 2 rounds of revisions allowed.

   • Body X, Y, Z Rigging: 2 rounds of revisions allowed.

   • Physics: 2 rounds of revisions allowed.

Illustration Animation Revisions

• 3 rounds of revisions are allowed.

• Any additional revisions will incur extra charges.

PNGTuber Revisions

1. Initial Design Phase

   • Sketch: 2 rounds of revisions allowed.

   • Line Art: 1 round of revisions allowed.

   • Colour: 1 round of revisions allowed.

2. Rigging Phase

   • 2 rounds of revisions are allowed.

Illustration Revisions

1. Initial Design Phase

   • Sketch: 2 rounds of revisions allowed.

   • Line Art: 1 round of revisions allowed.

   • Colour: 1 round of revisions allowed.

Other Projects

• For projects outside the scopes mentioned above, revisions will be arranged on a case-by-case basis.

Deadlines and Delivery

1. Estimated Delivery Time
   Unless otherwise agreed upon, the estimated delivery time is within 3 months, which includes both queuing and rigging processes.

2. Rush Orders
   Rushed deadlines may incur additional charges. These must be discussed and agreed upon in advance.

Usage Rights

1. Commercial Use
   Commercial use of the commissioned work is prohibited without prior consent. Commercial use includes selling the deliverables or using them in corporate-backed projects. Indie Vtubers are exempt from this and do not need to pay for commercial use.

2. Streaming and Content Creation
   Profits from streaming and integration with other content creation platforms are permitted.

Intellectual Property Rights

1. Client Responsibility
   The client is responsible for securing all necessary licenses and permissions for the project. Caturteer is not liable for any issues arising from a lack of proper licensing.

2. Client Rights
   The client will receive the agreed-upon rights and licenses to use the completed work. Under normal circumstances, Caturteer will not interfere with the client’s use of the project.

3. Caturteer Rights

   • Caturteer retains the copyright to all works created.

   • Caturteer reserves the right to copyright claim or request additional payment if the completed project is used in a manner not agreed upon (e.g., using a personal commission for commercial purposes).

4. Portfolio and Promotional Use
   Caturteer reserves the right to use the work for portfolio purposes, showcase submissions, social media posts, zines, and other promotional material unless otherwise agreed.

5. No Resale
   Caturteer will not resell the work or use it for merchandise that generates additional profit.

6. Credit
   Where possible, please credit the work to "Caturteer."

Refund Policy

1. Pre-Commencement
   If the project has not yet commenced (i.e., still in the project queue), a refund of up to 50% may be possible on a case-by-case basis.

2. Post-Commencement
   Once the project has begun, no refunds will be issued.

Communication

1. Preferred Communication Channels

   • Discord or Twitter group chats may be created to facilitate communication. Please ensure your account can be added to these group chats.

   • Email communication is also available if the client prefers this method.

   • Communication through VGen Messenger is acceptable, but only if the project is requested and paid through VGen.
